Port State measures

4.2.1 Extent to which CCAMLR has adopted measures relating to the exercise of the rights and duties of its Members and Contracting Parties as Port States, as reflected in the Code of Conduct for Responsible Fisheries Article 8.3

4.2.2 Extent to which these measures are effectively implemented

Recommendation Responsible body Activities to date Status
4.2.2.1 CCAMLR should determine the format and minimum content of inspection reports and should set minimum timelines for their submission. Enhanced port inspection reporting would also provide a further means of verification of the CDS in an enhanced catch reconciliation system. SCIC (2008)CCAMLR-XXVII, Annex 5, paragraphs 7.4 and 7.5.
Adoption of a standard port inspection report form as part of CM 10-03;
(2009)CCAMLR-XXVIII, paragraphs 8.3 to 8.8;
(2009)CCAMLR-XXVIII, Annex 5, paragraphs 2.3 to 2.9 and 2.86
(2009)CCAMLR-XXVIII/40 Rev. 1 and CCAMLR-XXVIII/42
(2015)CCAMLR-XXXIV, Annex 6, paragraphs 131 and 132;
(2016)CCAMLR-XXXV, Annex 6, paragraphs 143 to 145.
SCIC - Complete

4.2.2.2 CCAMLR should develop a more comprehensive approach to port inspections by defining 'fishing vessels' to include reefer and support vessels, and widening the obligation to inspect to any fishing vessel suspected of carrying toothfish, or of having being engaged in fishing of that species in the recent past. The Commission may also wish to consider expanding inspection arrangements to cover all species harvested within the Convention Area.

At present CCAMLR has no such definition of a ‘fishing vessel’, and the most comprehensive statement of what constitutes ‘fishing’ is that found in paragraph X of the System of Inspection. The proposal in paragraph 2 above would not only enhance Port State inspections, but would also allow for the strengthening of other MCS provisions.

SCIC (2008)CCAMLR-XXVII, Annex 5, paragraph 7.5.
CM 10-03, paragraph 5 now includes a definition of fishing vessel which includes cargo, reefer and support vessels.
Proposal to strengthen CM 10-03 under consideration;
(2009)CCAMLR-XXVIII, paragraphs 8.3 to 8.8;
(2009)CCAMLR-XXVIII, Annex 5, paragraphs 2.3 to 2.9 and 2.86;
(2009)CCAMLR-XXVIII/40 Rev. 1 and CCAMLR-XXVIII/42 ;
(2010)CCAMLR-XXIX, Annex 6, paragraph 7.3;
(2011)CCAMLR-XXX, Annex 6, paragraph 2.75;
(2011)CCAMLR-XXX/28 ;
